Once a student has been deemed eligible, federal law requires that each child must then receive an IEP designed to meet his or her unique needs. For those students who may not be eligible for special education, they may still require accommodations if they have a disability that substantially impacts a major life activity. In those circumstances, he or she may be eligible for reasonable accommodations through a Section 504 plan.
When a student is suspected of having a disability that has an adverse impact on his or her ability to learn, that student shall be referred to the Child Study Team by either parents or school district personnel to be evaluated for special education and related services.
The purpose of the IDEA is to ensure that all children with disabilities have available to them a free, appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living.
